TO GOODS – Merchandise and equipment
shall remain with McDonnell Marine Service, LLC,
until the total purchase price of the goods,
merchandise and equipment has been paid in full.
The purchaser agrees to pay a service charge
for 1.5% per month (18%) ANNUAL RATE on amounts
not paid within 30 days following the date of
sale of such goods, services, merchandise and
equipment. In the event of the default of the
purchase in payment for the goods, services,
merchandise and equipment sold hereunder, no
further charges of purchases will be allowed.
PURCHASER FURTHER AGRESS TO PAY ALL COSTS OF
COLLECTION OR ENFORCEMENT THEREOF INCLUDING REASONABLE
ATTORNEY’S FEES. THE PURCHASER ACKNOLEDGES
THAT THEY HAVE READ THIS AGREEMENT UNDERSTANDS
THE SAME AND ACKNOWLWDGES THE RECEIPTS OF THIS
OF PURCHASER’S REMEDIES – The
purchaser’s remedies, in the event of any
claim made by the purchaser against McDonnell
Marine Service, LLC (hereinafter referred to
as MCM) in force at the time order is shipped
apply. No others expressed or implied. Any warranties
or conditions in a purchase order or elsewhere
to the contrary not withstanding. MCM makes no
expressed or implied warranties whatsoever beyond
that which is published by the manufacturers
of merchandise or any parts thereof sold by MCM
and makes NO WARRANTY OF MECHANTIBILITY or fitness
and of any particular purpose of any component
whether sold separately or installed in assemblies
or of any design or system utilizing components
sold by MCM.
These warranties are limited solely and exclusively
to repair or replacement of engine or parts including
removal and reinstallation according to the terms
of the manufacturers warranty and does not include
any liability for any incidental consequential
or other damage of any kind whatsoever. If and
to the extent the US Public Law # 93637 (The
Magnuson-Moss Act) is applicable as to the products
manufactured, these warranties are Limited Warranties.
These limited warranties do not cover merchandise
that fail due to abuse, misuse, neglect, alterations
or accident or which have been improperly lubricated
or repaired, misapplied or used in applications
for which they were either not designed or not
approved by the manufactured or MCM, or are cleaned
adjusted or replaced as a part of normal maintenance
or failures caused by non warranted merchandise.
RETURNS - Must be within 15 days of invoice,
must have our authorization, received by us,
freight prepaid, in original condition, and will
credited at price billed less 15% handling charge.
Hoses, seals, electrical and certain other parts
INFORMATION - It is your responsibility to
be present to accept shipments. FEDEX & UPS
will not leave packages without a signature unless
prior arrangements have been made. Calling FEDEX
at 800-463-3339 OR UPS at 800-742-5877 in advance
can make those arrangements. Tracking information
can be supplied also by calling those toll free
numbers or online at www.ups.com or www.fedex.com
. We will gladly supply Tracking numbers whenever
possible via phone, fax or email by request.
DO NOT REFUSE PACKAGES WITHOUT OUR PRIOR KNOWLEDGE
as this may delay credits due to you and MCM.
We are not responsible for delays or damage after merchandise is accepted by
any Transportation Company.
IN TRANSIT - Our packing is expertly
done with consideration given to type of article
and carrier. Should damage occur, please note
the details on freight bill and immediately file
proper claim with the transportation company.
Damage in transit is the responsibility if the
SHORTAGES – Any
errors in shipment must be reported within
5 days of receipt of goods.
INSPECTION – the
purchaser represents and acknowledges that
they have inspected goods,
merchandise and equipment sold hereunder, finds
the same to be in satisfactory condition, properly
operating and fit for the use intended by the
PRIVACY - We protect your privacy at MCM. Our
Policy is intended to provide you with the safest
and most secure shopping experience possible.
We will not rent or sell your name, address,
email address, credit card information or personal
information to anyone. However, we must cooperate
fully should a situation arise where we are required
by law or legal process to provide information
about a customer.
ORDERS – Back order items will be
shipped as soon as available.
